FOLLOWING IS A SAMPLE CONTRACT THAT WILL BE SENT FOR YOU TO SIGN IF YOU RENT OUR HOME.

SHORT TERM RENTAL AGREEMENT

Thank you for choosing our home for your vacation. We hope that you have a pleasant stay and enjoy it as much as we do. Tenant and Owner agree to this Short Term Rental Agreement (“Agreement”) as follows:

OWNER ACCESS: Owner or Owner’s representatives shall have reasonable access to the Property for purposes of repair and inspection.

SECURITY DEPOSIT: The security deposit shall not be applied to the rent by the Tenant. Owner may apply the security deposit to excess, cleaning charges, taxes, damages, missing furnishings, or any charges due under this Agreement. The security deposit balance will refunded to Tenant after Owner receives all final bills (which could take up to 60 days).

RULES AND REGULATIONS: Tenant and all guests on the Property shall abide by the Rules and Regulations set forth in this Agreement at all times while at the Property.

SMOKING: Smoking is not permitted at any time anywhere in the house.

PETS: No animals or pets of any kind are to be brought onto the Property.

EXCESSIVE NOISE: Excessive noise at a level that disturbs neighbors is prohibited. Quiet hours are from 10:00 p.m. to 8:00 a.m.

RISK OF LOSS: Tenant (not Owner) is solely responsible for (1) any accidents or injuries that occur while on the Property; and (2) the loss of personal property of the Tenant or any guests.

MAINTENANCE: Owner shall be responsible for maintaining the Property unless damage is caused by Tenant’s misuse or neglect. Tenant shall notify Owner of any needed maintenance.

NO DAILY HOUSEKEEPING SERVICE: There is no daily housekeeping service provided by Owner.

FURNISHINGS: Owner provides towels, linens, cups, knives, forks, spoons, dishes, and other items as commonly used by the Owner’s family. Toilet paper, soap, dish detergent, laundry soap, shampoos, and other consumables are to be purchased by the Tenant. If consumables are at the Property when the Tenant arrives, the Tenant is free to use them. No reimbursement will be made for unused consumables left at the Property.

BEACH TOWELS: Beach towels are not provided by Owner and should be supplied by Tenant. Towels or linens are not to be taken from the Property or used as beach towels.

OWNER’S CLOSET: Owner’s closet will be identified. Tenant shall not access or use the Owner’s Closet. Tenant shall not remove any item from the Owner’s Closet, even if the Owner’s Closet is unlocked.

POOL: Tenant acknowledges that the pool on the Property can be dangerous, and there is no lifeguard on duty. Tenant accepts fully the risks involved with use of the pool. Tenant will learn about safety precautions, water conditions, and safety procedures concerning swimming in or being around the pool. There are no rails to prevent a fall into the pool. Tenant shall have a responsible adult supervising minors at all times while the minors swim in the pool. No glass items are to be taken to the pool area. Wristbands will be provided for guests and must be worn while at the pool. Wristbands must be left at the condo at checkout; charges will be made to the security deposit for lost / stolen wristbands.

TRASH PICK UP: Tenant must take all trash in bags to the condo dumpster area and deposit trash in dumpster, no loose trash is permitted. Boxes must be broken down prior to disposal. Garbage bags will be provided. No fish entrails are permitted in dumpster.

FIREWORKS: Fireworks and other hazardous materials shall not be used in or around the Property.

USE OF PROPERTY: Tenant shall use the Property for legal purposes only. Using the Property inappropriately (e.g., illegal drug use, abuse of any person, harboring fugitives, etc.) shall cause termination of this Agreement with no refund of rents or deposits.

FIRE EXTINGUISHER: A fire extinguisher and first aid kit are provided in the laundry alcove in the kitchen. Another fire extinguisher is located on the patio adjacent to the grill. Tenant shall notify Owner immediately should the fire extinguisher become less than fully charged or supplies from first aid kit are used. Tenants shall use the fire extinguisher only for emergencies. Open flames of any sort are prohibited in the home.

SECURITY: Tenant shall lock doors and windows when it is prudent to do so.

VALUABLES: If Owner finds valuable items left behind by Tenant, Owner will make a reasonable effort to contact the Tenant to make arrangements for their return. Owner is not liable for the condition of the items. Items not claimed within six months shall become the property of the Owner.

INTERNET: Owner provides Internet at service levels selected by Owner for convenience only and not integral to this Agreement. No refund or credit shall be given to Tenant for outages or slower than expected service. Tenant is responsible for any additional internet charges incurred by Tenant or any Tenant guest.

OUTAGES: Outages beyond the control of Owner are experienced occasionally. No refunds or compensation will be given for any outages.

NO REFUNDS: There shall be no refunds of rents because of shortened stays or ruined expectations due to work or family emergencies or other commitments.

FIREARMS: Firearms shall be allowed on the Property only as permitted by state and local laws.

FIREPLACE: The fireplace is NOT to be used by Tenant. Any attempt to use fireplace will be cause for the surrender of the security deposit.

PARKING: Vehicles are to be parked in designated parking areas only. Immediately in front of the unit ONE parking space is provided for Tenant, do not take other adjacent spots as these are for the other units. There is a pay lot located a short walk away downtown for any additional vehicles. Parking on the road is not permitted. Illegally parked cars are subject to towing, and any applicable fines/towing fees shall be the sole responsibility of the vehicle owner.

STORMS/LOW WATER: The property is located on an island, access to the island may be limited during stormy weather or during low water conditions caused by storms. If the Property is unable to be used by Tenant because the Kellys Island Ferry is not running Owner will refund to Tenant, the portion of the rent covering the period that Tenant is not able to use the Property. There must be documentation that the Ferry has been cancelled. Refunds will not be issued due to Tenant choosing not to ride for any reason.

PAYMENT: 50% of total to be paid at time of booking and the remaining 50% paid 30 days prior to check-in.

CANCELLATION: Tenant may cancel this Agreement and receive a 75% refund of total fee if written cancellation is provided to Owner no less than 60 days prior to check-in date.

TENANT OR GUESTS UNDER 25: Tenant or guests under the age of 25 unaccompanied by a parent or legal guardian will not be permitted to use the Property and may be removed from the Property; in such event, all funds paid to Owner will be forfeited.

CHECK-OUT TIME: Failure to check-out by 10:00 a.m. may result in an additional charge.

INDEMNIFICATION: Tenant agrees to indemnify and hold harmless Owners and Owner’s agents from claims, suits, or damages of any kind, from or related to any acts or omissions of Tenant or Tenant’s guests.

SIGNATURES: Signatures of the parties transmitted by facsimile and/or by electronic mail in Portable Document Format (PDF) or any other similar method shall be deemed to be their original signatures for all purposes.
